CLAIMS AND EVIDENCE

What is freedom of speech?
The right to speak freely is a rule that supports the opportunity of an individual or a network to verbalize their suppositions and thoughts unafraid of counter, control, or legitimate assent. Freedom of expression is perceived as a human appropriate under article 19 of the All-inclusive Announcement of Human Rights (UDHR) and perceived in global human rights law in the Universal Contract on Common and Political Rights (ICCPR). Article 19 of the UDHR states that "everybody will reserve the option to hold assessments without impedance" and "everybody will reserve the privilege to opportunity of articulation; this privilege will incorporate opportunity to look for, get and bestow data and thoughts of numerous sorts, paying little mind to boondocks, either orally, recorded as a hard copy or in print, as workmanship, or through some other media of his decision". The adaptation of Article 19 in the ICCPR later revises this by expressing that the activity of these rights conveys "uncommon obligations and duties" and may "along these lines be liable to specific limitations" when vital "for regard of the rights or notoriety of others" or "for the insurance of national security or of open (request open), or of general wellbeing or ethics"

How does freedom of speech improve a society?

Freedom of expression is a central human right. It strengthens all other human rights, enabling society to create and advance. The capacity to express our sentiment and talk openly is fundamental to achieve change in the public arena. Free discourse is significant for some different reasons.

Should there be some limits on what we are free to say?
In my opinion, I am for the United States Court, there they state;

Freedom of speech does not include the right:
·      To incite actions that would harm others (e.g., “[S]hout[ing] ‘fire’ in a crowded theater.”).
Schenck v. United States, 249 U.S. 47 (1919).

·      To make or distribute obscene materials.
Roth v. United States, 354 U.S. 476 (1957).

·      To burn draft cards as an anti-war protest.
United States v. O’Brien, 391 U.S. 367 (1968).

·      To permit students to print articles in a school newspaper over the objections of the school administration.
Hazelwood School District v. Kuhlmeier, 484 U.S. 260 (1988).

·      Of students to make an obscene speech at a school-sponsored event.
Bethel School District #43 v. Fraser, 478 U.S. 675 (1986).

·      Of students to advocate illegal drug use at a school-sponsored event.
Morse v. Frederick, __ U.S. __ (2007).

Should you be free to tell an enemy your country’s national secrets?

No and here’s why. We have a strong basis as the leading country in just about everything in the world, we pay for a lot of things we shouldn’t be paying for (which would solve our debt but I am not getting into that), and our international aid is more than any other country at this current rate. Since we help so many people and are internationally looked up to other enemy countries are trying to bring us down so they can go forth with their own agendas on countries we help and aid. If our national secrets get out and can be exploited that is a potential for our country and everyone in it to suffer. So the answer to that is it should be more illegal than it is now.

Does freedom of speech include spreading lies about people?

No, but ‘Freedom of Speech’ does include persons saying ‘untruths’. ‘Lies’ are knowing deceptions. Untruths can be just that someone is mistaken.
If it were not allowed for people to utter ‘untruths’ (i.e. to be ‘mistaken’) it would be impossible for people to address those untruths and correct them. More over what authority can judge which statement is True and which is an untruth? Laws (such as libel laws) can deal with deliberate lying or deception. Laws couldn’t and shouldn’t penalize mistaken speech. That is the responsibility of dialogue, research, evidence and reason to sort out. John Stuart Mill, in ‘On Liberty’ defends the necessity of wrong ideas and their expression. His defense is many-pronged, but not least because Truth once established becomes ‘assumptions’ and is therefore held in an uninformed, shallow manner. Such Truths become vulnerable to specious attacks because they have never had to be defended. A Truth that is regularly questioned (and therefore ‘defended’) is defended and justified in a more profound matter and therefore remains a ‘living’ truth - not a fossilized truth.

How can democracy be possible without freedom to share ideas?

Democracy and Freedom. Each individual has the privilege and opportunity of idea, conviction, having a political sentiment, the decision to satisfy or not to satisfy the prerequisites of his picked religion. The rights and opportunities of others and the country's regular advantages limit singular opportunity.
